Happy new financial year…
At this time each year, the Smarter SMSF team implements a range of changes across the platform, including to a number of order forms and generated document templates. Whilst it might not look like much from the outside, making these updates and changes ensure that templates remain up-to-date to allow you to have ready access to compliant documents in an ever-changing superannuation and tax laws environment.
To understand the changes that we have made on Smarter SMSF platform from 1 July 2024:
Ordering documents
ASIC fees
From 1 July 2024, Smarter SMSF has revised its fees for company incorporations to reflect the ASIC fee indexation – you can read more about these changes in our related knowledge base article below – ASIC fees from 1 July 2024
New SMSF
The team at Smarter SMSF has been busily making changes to the structure of the Smarter SMSF deed and ancillary documents that have taken effect from 1 July for new fund establishments (including QROPS). A number of amendments to the Deed have also been made including (but not limited to):
- Rule 27 – dispute resolution
- Revised BDBN forms, that provide greater scope to list multiple beneficiaries and/or legal personal representative (LPR).
- Product Disclosure Statement (PDS) – updated for 2024-25 year
Detail of these changes can be found within the SMSF deed changelog for the Smarter SMSF Deed (Governing Rules, Version 2024-07). The changelog and a revised copy of the sample documents for the ‘Fund Establishment’ can be within the Smarter SMSF knowledge base (NB. Available for member-only access or can send a copy upon request).
Please note that the updated governing rules have also been applied for Trust Deed Updates (Deed of Variation) and Lost Trust Deed.
LRBA:
We have made a number of updates across the LRBA documents, including the Bare Trust, LRB Agreement and Related Party Loan Facility Agreement, in particular around the requirements to register a mortgage in respect to the acquired asset by the Bare Trust. Specific details of these adjustments can be found within the Smarter SMSF knowledge base.
For the loan facility agreement, the safe harbour interest rates have been adjusted to the new LRBA safe harbour interest rate of 9.35% for real property and 11.35% for listed shares/units for the 2024-25 year in accordance with the requirements set out in PCG 2016/5.
Pension Commencement / Lost Pension Deed:
For any new pensions commenced from 1 July 2024, the pension PDS has been updated for 2024-25 year – it includes a number of updates around events-based reporting, removing various references to 1 July 2017 super reforms, adding references to disability super income streams, along with the removal of ‘preservation to age 60’ references due to the increase of preservation age to 60 years. The Schedule within the PDS also reflects the super tax rates & thresholds for 2024-25.
Please note that all legal documents have now had their disclaimers updated to reflect that these documents have been prepared by an Australian Legal Practitioner and are maintained by appointed lawyers for Smarter SMSF (currently Hill Legal). The disclaimer also now incorporates the option to obtain legal advice utilising the Smarter Legal Review service.
